Driver jailed for speeding at 260kmh is cleared

BURGOS – A court cleared a man on Thursday who was driving at 260kmh because it found he was not posing any ‘definite danger’.

Constantino Garcia Suarez was condemned to six months in jail and had his licence withdrawn for two years.

He was stopped by police after his Audi A8 car was spotted speeding by a radar trap at 260kmh.

But the provincial court in Burgos, in northern Spain, absolved the sentence after finding he had not posed any ‘definite danger’, under article 381 of the Penal Code.

He was driving in good visibility on a clear road, the court heard.

Garcia appealed against the original jail term.

He will get his licence back after being banned for a year.

His lawyer said he was “delighted” with the court’s decision.
