A Conservative VVD MP says left-wing judges are trying to sabotage the government’s immigration policy.

THE NETHERLANDS - A number of Dutch MPs have reacted with dismay to a ruling by a judge in Roermond, overturning a requirement by the Dutch government that Dutch residents wishing to bring their partner to the Netherlands should earn at least 120 percent of the minimum wage.

Conservative VVD MP Henk Kamp voiced outrage in the newspaper De Telegraaf accusing what he called left-wing judges of sabotaging government policy.
 
According to Dutch immigration regulations, a resident must earn at least 120 percent of the minimum wage in order for his or her partner to be allowed to enter the country. The court in Roermond ruled that the means test was in violation of European law.

In Dutch law the distinction is made between rejoining a partner following an existing relationship and getting married or living together in a new partnership. The woman appearing in court in Roermond fits the last description. The relationship between her and the Sri Lankan man started when she was living in the Netherlands and he was not. However, European law does not recognise this distinction.
 
The Dutch justice ministry has announced it will appeal against the ruling.

Last week an Amsterdam judge overturned a rule stating that marriage migrants must pass an integration test in their countries of origin as a precondition to immigration. The court said marriage migrants should be allowed to take the test in the Netherlands.
 
Christian Democrats and Labour MPs attacked the former conservative Immigration and Integration Minister Rita Verdonk, blaming her for burdening the country with controversial legislation.

Verdonk proposed the means test for marriage migrants arguing that foreigners who start a family here should not place a financial burden on Dutch society.
 
Dutch immigrations lawyers are pleased with the ruling by the court in Roermond. In their opinion people with average jobs simply can not meet the requirements of the migrant means test.
