A court’s ruling to ban the use of a database of Antillean population has been overturned by the Council of State.

3 September 2008

THE HAGUE -- The Council of State has overturned a ruling by a court in The Hague banning the use of a database called the Antillean Reference Index for violating rights to privacy.

The database, which was set up by 21 municipalities with a large Antillean population, includes the personal data of criminal youths from the Netherlands Antilles.

A group representing Dutch people of Caribbean descent attempted to ban the racial database as discriminatory. The Netherlands Antilles has threatened to take legal action against the Netherlands.

The Dutch Data Protection Authority granted special permission for the creation of the database, which is to be evaluated in two years' time.
