Dutch court rules against paedophile ban

A court rules that Eindhoven cannot ban a convicted paedophile from returning to the city where he used to live.

Den Bosch – A court in Den Bosch ruled that Eindhoven city council is not entitled to ban a convicted paedophile from living in the municipality.

The court found the city council had failed to prove that the man would be a danger to public order.

Although the judge conceded the paedophile may re-offend, this did not constitute a threat to law and order.

The court ruled that the arguments presented by Eindhoven mayor Rob van Gijzel who said it was irresponsible to allow the man back into the city, citing fears of unrest and revenge attacks in the neighbourhood where he lives, were unconvincing.

In early October, the city council of Eindhoven banned the 61-year-old man from returning home in Eindhoven after serving his prison sentence of 27 months.

The convicted paedophile who was found guilty of sexually assaulting two boys aged 10 and 13, after an earlier conviction for a similar offence two decades ago, was also sentenced to five years of probation.

As the man has appealed against his conviction, he is allowed to move freely and is not subject to probation measures.

The Dutch probation authorities are pleased with the ruling because the problem would be passed from one municipality to the next as mayors tried to keep paedophiles out of their cities.

Although there is no supervision of the paedophile, he had agreed not to move into the same neighbourhood as his victims and to undergo voluntary treatment.

The Netherlands introduced a policy of informing mayors when ex-convicts move into their municipalities following the commotion in Utrecht and Roermond when convicted paedophiles tried to move back in after serving their sentences.

    Convicted paedophiles should be chemical castrated. There is no meaning to let them go back in the society, spreading fear to all parents in their neighbourhood! The dutch laws in this regard are too weak!
