Hello
we have been renting a property in Rotterdam under a private 'rolling' contract with the landlord for the past 7 years The original contract is an English verion based on a Dutch contract. The landlord has indicated he is returning and wants me to vacate the property giving 2.5months notice.
Is this legal, does he need to prove he is relocating back into the house?

Hi Dafna, 

I have been renting a flat for the last 2 years. Originally we signed a 1 year contract, but we did not sign another contract for the second year. Our landlord has just given us 3 month notice to move out, (we have been good tenants). Is this amount of time short? Is there anything we can do to extend this? It is just not at a good time of us to move and it feels like a very short amount of time.

Hi Dafna,

My girlfriend and I rented an apartment in The Hague for some years. We ended the contract in August 2017 and now live in Ireland. Out of the blue I have now received a bill supposedly for payment of "higher than normal electricity costs" for the parking garage that was mandatory to rent with the apartment. Is there any requirement to pay this? I find it extremely odd and annoying seeing as I have ended the rental arrangement for some time now and especially since during the time we lived there the parking place was never used as we didn't have a car!

I am currently living in a house with 3 other students, renting one room of the house. The contract is meant to be until the of august, so a fixed period. I would like to move out earlier though - is that possible? so can I cancel the contract one-sided?

Dear Dafna,

I had a subletting agreement with a tenant of a big house in Rotterdam. Due to discomfort in the house, I decided to let the tenant know that I wanted to move out of the apartment. I did so with a one month notice. We had not written a sublet contract and I had to pay no deposit.

One week after I communicated my decision to him -at the beginning of April-, he decided not to accept my decision of leaving the apartment end of April and he claimed that I should move out the end of May, otherwise, he would kick me out that same day. Given the tense situation, I decided to leave the house the same day he notified me his decision, on the second week of April, which is one week after I had told him that I wanted to leave.

I had to urgently find a new place and I, therefore, lost the rent the money that I had paid him. I had paid the whole month of April and he kicked me out the 13th. I have asked him to give me my money back but he refuses to do so. I think this is quite unfair since he preferred to kick me out instead of working out a solution together. Is there a way that I could claim this money?
Also, I have not returned the key to him yet but I plan to do so through a notification by post since I don´t want to cross a word with him anymore. would this help?

Dear Dafna,

A few weeks ago I got in touch with the SpotIn rental agency because I was interested in renting from abroad an apartment published in Pararius. They agreed to rent it to me and sent me the contract and some payment instructions. It took me few days to take the decision because the contract was in Dutch, but once I get in touch with them they told me that they had already rented the apartment -I had no problem with this-. Then, they offered to me another apartment at the same price and I replied that I was interested, so they sent me a new contract. However, at the next day two things happened: first, I found a much better housing alternative, and second, I heard really bad references about this company in articles like this: https://www.sikkom.nl/spot-in-en-camera-investments-verrotter-wordt-de-groningse-huurmarkt-niet/ , so I decided not to sign a contract with them.
Today, I received a $120EUR invoice for them, and a message saying that they already did a lot of work for me, and so they are charging me a 'Cancelation fee'. Is this legal in the Netherlands?... As far I understand, anywhere in the World, you only have a legal agreement when you have a signed document!

Any advice is really welcome!

I have a question regarding the insurance of the house. If we rent out our house temporary for a period less than a year because we go abroad. It seems logical that our insurance protection against fire, storm and water damage is only valid while owners are occupying the house. Am I correct?
I just found out that in the general terms and condition that we have to report any change to the insurer including lease our house for others within 14 days. otherwise, we are not protected at all.

My problem is that my mortgage is bound to the bank where I got my insurance. Before I left the Netherlands, I was a bit reluctant to tell them that I will go away for a short time because most likely they will refuse somebody else is going to stay in our house. So, did not tell them firmly my plan, only discuss some insurance issues for temporary lease and did not confirm that we need to change our policy.
I already rent it out to some tenants for 4 months now without knowing that house is not covered. The current contract will end on 30th of April and new contract will start on 1st May 2018 for 6 months period.

As I missed the 14 days notice of change stated in terms if I tell them now for my new contract with the same tenants. Will they accept my request for fire insurance while tenants are there instead of me? I am thinking maybe just do not explain too much, just tell them I leave for 6 months and a friend will come to take care of my house starting from 1st of May. Will they know we are already renting for 4 months and I am currently abroad?
With our mortgage, it is difficult to explain in details. What do you suggest?
Also when I try to find another insurance company to get another insurance, they say that they can't offer me because we are a new client and we need to go to our original insurer.

I am an expat and I have got a job in the Netherlands in Eindhoven area, with around 2800€ salary per month (netto). I have never moved before in another country, that's why I need your help. Can you give some guidance on how I am supposed to look for rent, how to get in contact with the agency (by mail, by phone, etc.) what area should I choose and at what sum I should stop? Maybe what details should I ask? I can mention that I'm single and I'll start in June.

Hi Dafna,

I have signed a short term contract of 1 month starting 1st April 2018 till 1st May 2018 with the agency. I have signed the contract but no payment has been done. The payment needs to be done prior to check - in. But now I have found a better option. Can I cancel the contract? The contract clearly mentions that "The contract starts on 1st April 2018". But I have already signed it.
