AMSTERDAM — The schoolboy who shot and killed the deputy headmaster of a school in The Hague was jailed for five years on Thursday.

At the end of his jail term, he is to spend an indefinite amount of time in a maximum security hospital for prisoners with psychiatric problems.

A court in The Hague imposed the jail time with so-called TBS hospitalisation on Murat D, now 17, after finding him guilty of murdering teacher Hans van Wieren.

The shooting in the canteen of Terra College in The Hague on 13 January this year shocked the nation. It was the first time a Dutch student had murdered a teacher. Murat was 16 at the time.

Agreeing with the prosecution, the court decided to treat the defendant as an adult rather than applying juvenile sentencing criteria.

Under the TBS system, the prisoner stays in a secure hospital "at the government's pleasure" and may not be released until considered to be cured of the psychiatric imbalance associated with the crime.

Murat's defence team had argued at a hearing earlier in April that he was not totally accountable for his actions and had not intended to shot Van Wieren in the head.

A security camera in the canteen recorded how Murat walked up to the victim, pointed a handgun at him and pulled the trigger. Van Wieren was hit by a single bullet in the head and died later that evening in hospital.

Murat's lawyer said the security footage showed that her client turned his head just before he fired and the shot went astray. Murat said in evidence that he had intended to wound Van Wieren in the shoulder.

He told police and the court that he felt the teacher – who disciplined him on several occasions - was picking on him and was showing him disrespect.

Murat's father was also jailed this year in a separate case in which he tried to shoot and murder a taxi driver. Aiming from the back seat of the car, he had tried to shot the man in the head.

The victim managed to jump out of the car just in time but received gunshot wounds to his body.
