ASSEN – The public prosecution department (OM) demanded in court in Assen today that Henk van D. be sentenced to 30 years in prison and compulsory psychiatric treatment. Van D. is standing trial for the rape and murder of 12-year-old Suzanne from Tweede Exloërmond.

Public prosecutor Van den Broek said that Van D.'s diminished state of responsibility was the only reason the OM did not demand life in prison.

Van D. (46) told the court on Friday that he lost control when the girl called him a paedophile after he raped her.

Van D. had not mentioned this in his confession to police. Van D. says the girl's accusation caused him to become outraged, leading him to strike and kick her and then run over her twice in his caravan.

The accusation hit a nerve with Van D. because he had been previously labelled a paedophile in the village where he lived. Van D. denies he is a paedophile and conclusions from the Pieter Baan psychiatric observation clinic seem to support him in this claim.

The Pieter Baan centre has recommended he be sentenced to compulsory psychiatric treatment and identified him as mentally retarded and prone to become aggressive when cornered.
