THE HAGUE -- The Council of State has ruled that Dutch Deputy Justice Minister Nebahat Albayrak should order the release of a Chinese migrant who is in the Netherlands illegally. There is little chance of the man being deported to China in the near future, as Beijing is refusing to co-operate in the repatriation of any illegal Chinese immigrants.

The council, the highest government advisory body, says such people should only be held in custody if they are about to be deported.

The ruling is likely to affect dozens of other illegal Chinese immigrants who are being detained. They were among hundreds who sought asylum early this year, following a rumour that there was about to be an amnesty for illegal migrants.
