Court says charges against the police pressed by the allegedly-tortured ETA member were not fully looked into.

MADRID - The Constitutional Court on Tuesday ordered a lower tribunal to reopen an investigation into the alleged torture of a convicted ETA member while held in police custody.

The Constitutional Court ruled that the local San Sebastián court had failed to fully investigate the allegations presented by Alberto Viedma Morillas against the police officers who held him following his arrest on 28 February 2002 for the murder of army officer Francisco Casanova.

The judge in charge of the inquiry shelved the case because Viedma had refused to undergo a forensic examination to determine the extent of his injuries.

Viedma was subsequently sentenced to 30 years in prison for the murder of Casanova and for the 1998 killing of Tomás Caballero, a politician from Navarre.
