Woman who hit husband is cleared of jail

MADRID — The supreme court cleared a woman on Friday of attacking her husband during a fight at their home.
The woman was have found to have had legitimate cause to defend herself during the attack at the couple’s home over their plans to separate.
The court overturned an earlier decision by a provincial court in Albacete, which had condemned both the husband and the wife to between 8 and 9 months in jail respectively for domestic violence.
The supreme court said in is ruling the woman had used a legitimate defence.
The case revolved around a fight in the couple’s then home in April 2004 over their imminent separation.
A scuffle broke out and the man hit the woman to he floor.
The wife returned some blows causing her then husband slight injuries.
