MADRID - A resident of Bilbao will receive EUR 10,000 in compensation for having to put up with the noise from street cleaning trucks for two years.
The Supreme Court ruled that Bilbao City Hall must pay a resident for violating his rights every Sunday between 6.30am and 8.30am. Police reports confirmed that the sound level from the garbage collection and cleaning machines exceeded safety regulations for residential areas.
In 2003, the resident asked city authorities in vain to put an end to the noise. He then took his case to the Basque Superior Court of Justice, which ruled in his favour. City Hall appealed against the decision, but the Supreme Court has upheld it.
"Choosing the most inexpensive [cleaning] solution is recommended, but not when it poses a health risk or encroaches upon the privacy of residents," read the final sentence.
