Former Bertelsmann chief 'to appeal jail sentence'

Thomas Middelhoff, former chief executive of German media giant Bertelsmann, will appeal against a three-year jail sentence for tax evasion and fraud, his lawyer said in remarks published Sunday.

"We will appeal," lawyer Winfried Holtermueller told German newspaper Bild am Sonntag.

On Friday, a German court had found Middelhoff, also a former CEO of retail and distribution group Arcandor, guilty on 27 counts of fraud and three counts of tax evasion.

He was sentenced to three years, slightly less than prosecutors had been calling for.

The prison term is too hefty to qualify for suspension.

According to Bild am Sonntag, the court ordered Middelhoff, 61, to be detained immediately after the sentence was read out in case he tried to abscond.

It said he had presented an out-of-date passport to the court.
