Headscarf ban: Belgian state council dismisses pupil’s appeal

16th September 2009, Comments 0 comments

The state council has rejected the demand of a pupil from the Royal Athenaeum School in Antwerp looking to suspend the ban on wearing religious symbols, especially the Muslim headscarf.

The issue of the legality of the ban has never been defined by the Supreme Court, the student having waited too long to contest the new school rule now. The deadline for appeals has already been reached.

According to the council, the student could still contest the measure taken by the school to cement the ban, the decision to ban her from classes. However, it seems that the plaintiff will still choose to stay away from school.

The appeal is thus partially late and partially premature, admitted the state council.
