Court rules that all people legally residing in Belgium that suffer from a disability are entitled to invalidity benefit, regardless of their nationality.

December 14 2007 - The Constitutional Court has ruled that all people legally residing in Belgium that suffer from a disability are entitled to invalidity benefit, regardless of their nationality.

The ruling came as a result of a case brought by an American woman, who had been refused invalidity benefit by the Federal Department of Social Security. (PhotoNews) Up until now, only Belgians and certain categories of foreign residents, such as those from EU member states and people with refugee status, were able to claim invalidity benefit here in Belgium.

The disabled American plaintiff went to the Constitutional Court after she had been refused benefit.

The court ruled in her favour on the grounds of what the judge described as the discriminatory nature of the rules governing entitlement to invalidity benefit.
