BRUSSELS – Hundreds of couples are waiting for a new divorce law to come into effect on 1 September. This has emerged from a survey of divorce lawyers.

Law firms report that they have dozens of application documents lying ready to enter divorce proceedings under the new law. "Until now you had to be living separately for two years, now you will be able to divorce after living apart for a year. Many people who don't want to wait two years to get a divorce are now waiting for 1 September", confirms expert and professor of family law Frederik Swennen.

From now on maintenance payments awarded will no longer depend on any fault found, but will be dependent on a partner's income. The weaker partner will be able to apply for alimony, even years after the marriage is dissolved, unless he or she has committed a "serious mistake." "Lawyers will always advise their clients to claim a serious mistake has been committed."
