BRUSSELS – The juvenile department of the Brussels appeal court decided on Monday that Mariusz O. will not be handed over to the regular criminal court.
As a result, the Polish minor who helped murder Joe Van Holsbeeck in order to steal his MP3 player will not be tried as an adult, but will remain at the closed facility in Kasteelbrakel.
The appeal court says that there is noticeable progress in the boy's personality and his attitude about the incident. He still needs further counselling but both Mariusz and his family have been doing everything to cooperate with his counsellors. For this reason handing O. over for trial as an adult would be disastrous, the court said.
